These Terms & Conditions (“Terms”) govern your use of this website, xzyonems.com (the “Site”), which is operated by Eastside Emergency Medical Services LLC, doing business as Xzyon EMS (“Xzyon EMS,” “we,” “us,” or “our”). By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

The SMS Terms — Xzyon EMS Crew Alerts section below applies in addition to these Terms, and only to Xzyon EMS crew members who choose to enroll in that text-message program.

Using the Site

You may use the Site for lawful purposes only. You agree not to:

• Submit false, misleading, or fraudulent information;
• Interfere with, disrupt, or attempt to gain unauthorized access to the Site, its administrative areas, or its underlying systems;
• Use automated means to submit forms or to collect content from the Site in a way that is abusive or burdensome; or
• Use the Site in any way that violates applicable law.

Information on the Site

The Site provides general information about Xzyon EMS and its medical transportation services. Descriptions of services are for general information only and are not a guarantee of availability. To discuss a specific transportation need, please contact us.

The Site is not a means of requesting emergency assistance. In a medical emergency, call 911.

Forms and submissions

Information you submit through the Contact form or a Careers application is handled as described in our Privacy Policy. Submitting a form does not create a service agreement or an employment relationship, and providing a phone number through either form does not enroll you in Xzyon EMS Crew Alerts. Please do not include patient-identifying or other sensitive health information in a Contact form message.

Intellectual property

The Site’s content, including text, images, logos, and design, is owned by or used with permission by Xzyon EMS and is protected by applicable intellectual-property laws. You may not copy, reproduce, or redistribute it without our written permission, except as needed to view the Site normally.

Disclaimers and limitation of liability

The Site is provided “as is” and “as available.” To the fullest extent permitted by law, Xzyon EMS disclaims all warranties, express or implied, regarding the Site, and is not liable for any indirect, incidental, or consequential damages arising from your use of the Site.

Changes to these Terms

We may update these Terms from time to time. If we make changes, we will revise the “Last updated” date at the top of this page. Your continued use of the Site after a change means you accept the updated Terms.

SMS Terms — Xzyon EMS Crew Alerts

Xzyon EMS Crew Alerts (the “Program”) is a text-message (SMS) program operated by Eastside Emergency Medical Services LLC, doing business as Xzyon EMS. These SMS Terms describe how the Program works. They apply only to you if you enroll in the Program.

Who can enroll

The Program is available to eligible Xzyon EMS crew members who voluntarily enroll. It is not offered to the general public.

How you enroll

Enrollment takes place through the Xzyon EMS Crew application, using an explicit SMS consent control. The Program does not enroll you automatically, and a phone number you provide through this Site (for example, on the Contact form or a Careers application) does not enroll you.

Voluntary consent

Your consent is voluntary. Consent is not required to use the Xzyon EMS Crew application and is not a condition of employment.

What messages you will receive

The Program sends operational notifications about dispatch assignments, reassignments, and cancellations. Each message states the call priority (RED, YELLOW, GREEN, or BLUE) and the unit name. The Program does not send marketing or promotional messages. The Program is not intended to transmit patient-identifying information or protected health information.

Message frequency and costs

Message frequency varies. Message and data rates may apply, according to your mobile carrier plan.

Opt out, opt back in, and help

Reply STOP to opt out of the Program at any time. After opting out, reply START to opt back in. Reply HELP for assistance. You can also manage your SMS enrollment through the SMS preference in the Xzyon EMS Crew application.

For general assistance, contact Xzyon EMS at admin@xzyonems.com or through our Contact page. These contacts are for general assistance only and are not a way to opt out of the Program; to opt out, reply STOP or change your SMS preference in the Xzyon EMS Crew application.

Carriers

Wireless carriers are not liable for delayed or undelivered messages.
